Terms of Service

These terms are an agreement between you and TEX Vietnam Technology Joint Stock Company (Công ty cổ phần công nghệ TEX Việt Nam, "TEX Vietnam JSC"), trading as TEXVN ("Simulic", "we", "us"), the operator of simulic.com and its related domains (the "Service"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

1. Who may use Simulic

• Accounts are for adults (18 years or older): teachers, tutors, parents and other educators or creators. You confirm your age when you complete your account.
• Students do not need an account and must not create one. Teachers share simulations with students through links, QR codes, embed codes or their school's learning platform. Students open those links without signing in.
• If you use the Service on behalf of a school or organisation, you confirm that you are allowed to accept these terms for it.

2. Your account

• You sign in with a link sent to your email address or with your Google account. There is no password. Keep your email account secure and sign out on shared devices; you are responsible for what happens under your account.
• Give us accurate information (name, country, subject). You can change it at any time in Account.
• We may suspend or close an account that breaks these terms, harms the Service or other users, or has been inactive for a long period. You can close your account yourself at any time (section 8).

3. The Simulic library

The simulations published on simulic.com (the "Library") are created and owned by TEXVN. We grant you a free, non-exclusive, worldwide licence to:

• run Library simulations in your lessons, in person or online;
• share them with your students using the links, QR codes and embed codes that the Service generates;
• embed them on your school website or learning platform using the embed code, with the attribution the code contains.

You may not:

• download, copy, store, mirror or redistribute simulation files, or remove the technical measures that protect them;
• sell, rent, sub-license or bundle Library simulations in a paid product, course or platform;
• use automated tools to crawl or scrape the Library, or request simulation files at a rate that is clearly not classroom use;
• remove or hide the Simulic attribution from embedded simulations;
• present Library simulations as your own work.

Simulations are built for teaching. They simplify real phenomena and may contain errors. Check them against your curriculum before you rely on them, and use Report a problem when you find a mistake.

4. Share links and embeds

• Share links and embed codes are yours to manage: you can rename, disable and delete them. A disabled link stops working for everyone who has it.
• Links are for teaching. Do not use them to distribute simulations outside an educational context, or to a public audience in a way that replaces the Library.
• Simulic counts how many times each link is opened. It does not identify, track or store anything about the people who open a link (see the Privacy Policy).
• The "Share to Google Classroom" and "Share to Microsoft Teams" buttons are provided by Google and Microsoft. Their use is governed by those companies' terms.

5. Simulations you create with AI

• You can create new simulations from a description, or remix a Library simulation or one of your own. The Service sends your description and, for a remix, the source simulation to an AI model and checks the result before saving it.
• Your prompts and the simulations produced for you ("Your Simulations") are yours to use for teaching. Between you and us, you own Your Simulations to the extent the law allows, subject to our rights in any Library material a remix is based on. A remix of a Library simulation may be used under the same licence as the Library (section 3): it may not be sold or redistributed.
• You grant us a licence to store, process, display and deliver Your Simulations so that the Service works: for you in My simulations, and for the people who open the links you share. We do not publish Your Simulations in the Library unless you propose one for it and we accept it; in that case you grant TEXVN a free, perpetual, worldwide licence to publish, translate and adapt that simulation in the Library. We do not use Your Simulations to train AI models.
• You are responsible for what you ask the AI to create and for checking Your Simulations before using them in class. AI output can be wrong, incomplete or unsuitable; we do not review it.
• Do not create simulations that are unlawful, that infringe someone else's rights, that are sexual, hateful or violent, that target or collect data from students, or that attempt to break out of the sandbox in which simulations run. We may remove such simulations and close the account.
• Your Simulations run on a separate content domain in a restricted sandbox. We may change how they are stored and delivered, and we may remove simulations that have not been opened for a very long time after notifying you.

6. Credits and payments

• Creating, remixing and editing simulations with AI uses credits. Playing simulations and sharing them never uses credits. The current prices in credits are shown on the Credits page before you start a job.
• New accounts receive a number of free credits. We may change the amount for new accounts at any time; credits already granted are not affected.
• You can buy credit packs. Payments are processed by Paddle.com Market Ltd or its affiliates ("Paddle"), our merchant of record. Paddle's buyer terms apply to the purchase; Paddle handles your payment details, invoices, taxes and refunds under those terms.
• Credits have no cash value, cannot be transferred to another account and cannot be exchanged for money. Credits expire twelve months after they are added to your account; expired credits are removed. Free credits may expire sooner if we say so when granting them.
• If an AI job fails, the credits it used are returned to you automatically. Credits used by a job that succeeded are not refunded, even if you do not like the result; you can edit the simulation or try again.
• If you close your account, unused credits are lost. Purchases are refundable only as required by law or by Paddle's terms.

7. Acceptable use

Do not: interfere with the Service or its security; access other users' accounts or simulations; upload malware; use the Service to send unsolicited messages; misrepresent who you are; or use the Service in a way that breaks the law or these terms. We may rate-limit, suspend or block use that we believe is abusive.

8. Closing your account

You can export your data and delete your account at any time from Account. Deleting your account removes your profile, your share links, Your Simulations and your credit balance. Links you shared stop working. Some records are kept as described in the Privacy Policy (for example payment records required by tax law).

9. Changes to the Service and to these terms

We keep improving the Service and may add, change or remove features, simulations and languages. We may also change these terms. If a change is material, we will tell you by email or when you next sign in, and you will be asked to accept the new terms before you continue. Continued use after that is acceptance.

10. No warranty

The Service and all simulations are provided "as is" and "as available". To the fullest extent permitted by law we make no warranties, express or implied, about the Service, its accuracy, availability or fitness for a particular purpose. Simulations are teaching aids, not authoritative references.

11. Limitation of liability

To the fullest extent permitted by law, TEXVN is not liable for any indirect, incidental, special or consequential loss, or for any loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim arising from the Service is limited to the amount you paid us in the twelve months before the claim, or USD 50, whichever is greater. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence or for fraud, or your statutory consumer rights.

12. Governing law and disputes

These terms are governed by the laws of Vietnam, where TEXVN is established. If you are a consumer in the European Union, the United Kingdom or another jurisdiction that grants you mandatory protections, you keep those protections and may bring a claim in your own courts. Before starting any formal proceedings, please contact us so that we can try to resolve the problem informally.

13. General

These terms, the Privacy Policy and any prices shown in the Service are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. If we do not act on a breach, that is not a waiver. You may not transfer this agreement; we may transfer it to a successor of the Service, with notice to you.
